Durban high court dismisses former Deputy Mayor's application to interdict council for voting him out of office

DURBAN HIGH COURT DISMISSES FORMER DEPUTY MAYOR'S APPLICATION TO INTERDICT COUNCIL FOR VOTING HIM OUT OF OFFICE
 
EThekwini Speaker Cllr Thabani Nyawose has welcomed the verdict of the Durban High Court which today dismissed an application by the former Deputy Mayor Philani Mavundla to interdict the Council from removing him from office.
 
Mavundla had on 15 December brought an urgent application against the Speaker and the Municipality, seeking an interim interdict against the council resolution of the 13th of December 2022 removing him as a Deputy Mayor and Exco member.
 
“We have been vindicated by the court. Today, the  30th of December 2022, it delivered its judgment where it found that we complied with the law when placing the motion for the removal of the former Deputy Mayor on the Council agenda of the 13th of December.  The court further ruled that the council had not breached an earlier order granted in favour of the former Deputy Mayor on the 12th of December,” said Nyawose
 
Nyawose says under his stewardship of the eThekwini Council rules will be adhered to.
