Bylaws Relating to Bus Ranks and Routes
BYLAWS RELATING TO BUS RANKS AND ROUTES
Section 1 - Establishment of Public Bus Ranks (1) The ranks or stands (hereinafter referred to as bus ranks) in the portions of public roads and places open to the public and on the areas of land described and enumerated in the First Schedule to these bylaws are hereby established as special parking places for the parking of passenger-carrying public motor vehicles of the class known as public buses including those operated by the City Council and which are authorised to use such bus ranks by Bus Rank Permit issued in terms of these Bylaws. Such bus ranks shall be indicated by traffic signs and markings erected and marked in accordance with the relevant provisions of Chapter XII of the Road Traffic Regulations, published under Provincial Notice No. 423 of 1972, as amended, from time to time. (P.N. 133/75; 494/79; 105/88) (2) (a) The City Engineer shall cause to be set aside and demarcated in each bus rank, in the manner hereinafter provided, a specific area or areas subdivided into spaces (hereinafter referred to in these bylaws as "loading bays"), to be used exclusively for the purpose of accommodating public buses only while picking up or off-loading passengers; provided that each bus service for which the bus rank concerned is reserved in terms of section 2 of these bylaws shall be allocated the right to use at least one loading bay in such rank either separately or in conjunction with other services for which the rank is so reserved and the number of loading bays to be allocated to any particular service shall be decided by the City Engineer with due regard to the total number of bays available in the bus rank and the number of vehicles operated by the owner or owners of the service concerned. (b) Any area remaining in any bus rank after the loading bays have been set aside and after provision has been made for purposes ancillary to the bus rank, including provision for the convenience and accommodation of intending passengers, and the entry and exit of vehicles and pedestrians, may be made available by the City Engineer for the purpose of setting down passengers or for the parking of buses whilst not engaged in picking up or loading passengers. Such areas may but need not necessarily be subdivided and such subdivisions may be allocated for the use of specific services. (c) Loading bays and unloading or parking areas set aside or made available in terms of this section, may be demarcated by notices, signs or markings or be otherwise identified and the allocation or reservation of loading bays may also be effected by means of notices, signs or other suitable marking. (d) Whenever he considers it reasonably necessary to do so in order to ensure the fair and equitable distribution between the various Bus Rank Permit holders of the accommodation available in any parking area in terms of paragraph (b) hereof, the City Engineer may by notice erected at or near the entrances to such parking area stipulate the maximum continuous period during which a bus may be parked thereon. (e) In setting aside or demarcating loading bays or unloading or parking areas or any other areas necessary for purposes ancillary to the use of a bus rank or in stipulating the maximum continuous parking periods in any parking area, endeavour shall be made to ensuer the fullest and most effective use of such bus ranks in the interests of both the permit holders and passengers, having due regard to the proper regulation of vehicular and pedestrian traffic at or near any bus rank. (P.N. 133/75; 494/79; 254/87) (3) The Council may close, temporarily any bus rank or any portion thereof, established under these bylaws, but, if necessary shall establish elsewhere another permanent or temporary rank in lieu thereof. In cases of emergency, the powers conferred by this sub-section to close the bus rank temporarily may be exercised by the Chief Constable or his authorised deputy. 1A Nondiscrimination (1) Subject to the provisions of subsection (2) hereof, no provision of these Bylaws shall be applied so as to discriminate between persons on the grounds of race, religion or gender nor shall it be so construed so as to have the effect of authorising such discrimination. (2) Notwithstanding the provisions of subsection (1) hereof, discrimination on the grounds of gender may expressly be authorised in terms of any provision of these Bylaws which prescribes the wearing of appropriate apparel in a public place or imposes a restriction upon the entry of persons into public ablution, toilet and changeroom facilities or prescribes different standards for such facilities. (M.N. 43/92) 2. Bus Ranks allocated according to Destination of Buses (1) The several bus ranks established in terms of section 1 shall be for the exclusive use of public buses lawfully operating on routes having the destinations or outer terminal points detailed in the Public Road Carrier Permits issued in respect of such public buses and in the Bus Rank Permits issued in respect of such public buses; provided that this restriction shall not apply to a public bus the substitution or intercharge of which has been authorised in terms of sections 12 and 12A respectively. (P.N. 494/79; 212/82) (2) When any public bus is proceeding to any bus rank which it is authorised to use in terms of these bylaws, the owner of such vehicle shall cause the name of the bus rank to which it is proceeding to be displayed in the destination indicator of the vehicle in accordance with the provisions of subsections (1) and (2) of Section 136 of the Road Traffic Regulations published under Provincial Notice No. 681 of 1966, as amended, from time to time. (P.N. 133/75) (3) The provisions of this Section shall not however derogate from the authority conferred on the Chief Constable by sub-section (2) of Section 1 and Section 7 of these bylaws to allocate to or require any service or public bus for which the bus rank concerned is reserved in terms of sub-section (1) hereof, to use any particular loading bay or any parkig area or subdivision thereof which may be demarcated in any bus rank and/or specified in the permit issued in respect of any public bus. 3. Parking or Standing Time at Loading Bays No public bus shall be parked or allowed to stand upon any portion of a bus rank set aside as a loading bay for a longer period than fifteen minutes at any one time, and where any such vehicle has been so parked or allowed to stand upon such loading bay for any contintuous period not exceeding fifteen minutes it shall not again be parked or allowed to stand upon such loading bay or any portion thereof, until an interval of at least thirty minutes shall have elapsed. 4. Parking of Public Buses prohibited in certain Areas Except in the case of public buses permitted to so under these bylaws, at a bus rank established by the Council and notwithstanding any other provision in the Road Traffic Bylaws, no person shall park or cause or permit to be parked any public bus upon any public road within the area bounded by the following public roads, including the total width of the roads so named: Soldier's Way, Umgeni Road, Epsom Road, Dartnell Crescent, Centenary Road, Mansfield Road, Botanic Gardens Road, Berea Road, Umbilo Road, Sarnia Road, Edwin Swales V.C. Drive, South Coast Road, Maydon Road, Alexander Street, West Street, Grey Street and Commercial Road, and no person shall cause or permit any public bus to park in any parking place (not being part of a public road) within the curtilage of the City Market. (P.N. 133/75) 5. Unauthorised use of Bus Ranks Prohibited (1) No person shall cause or permit: (a) any vehicle of a class other than a public bus to park or stand upon any bus rank, unless in possession of a Bus Rank Permit to do so, issued in respect of such vehicle in terms of subsection (4) which Bus Rank Permit shall be in the form of a disc, as approved by the Chief Constable which shall be displayed on the left vent window of such vehicle; (b) any public bus to park or stand upon any bus rank unless in possession of a Bus Rank Permit to do so, issued in respect of such a public bus in terms of these bylaws; provided that this prohibition shall not apply to a public bus the substitution or interchange of which has been authorised in terms of section 12 and 12A respectively. (P.N. 494/79; 212/82) (2) No person in control of any public bus which is authorised by a current Bus Rank Permit to use any particular loading bay, parking area or subdivision thereof in any bus rank shall cause or permit such vehicle: (a) to park or stand upon or use any loading bay or parking area or portion or subdivision thereof other than that allocated in respect of such vehicle in terms of such Bus Rank Permit, or in terms of Sections 1 and 2 of these Bylaws as the case may be; (b) to park or stand upon or in any way occupy any loading bay for a longer continuous period than fifteen minutes; (c) to again park or stand upon or occupy any loading bay until an interval of thirty minutes shall have elapsed after such motor omnibus has been moved from the loading bay; (d) to park or stand upon any bus rank or portion thereof which is temporarily closed in terms of these Bylaws; (e) to remain unattended at any loading bay; (f) to stop, be parked in or stand upon any part of a bus rank other than a loading bay allocated in respect of such vehicle in terms of such Bus Rank Permit or an area demarcated in terms of section 1(2)(b), whether for the purpose of setting down or picking up passengers or otherwise; (g) to stop, be parked in or stand upon any part of a bus rank set aside in terms of section 1(2)(b) for the setting down of passengers except for the purpose of setting down a passenger or passengers; (h) to stop, be parked in or stand upon any part of a bus rank so that any part of it crosses any marking which demarcates a loading bay or an unloading or parking area; (i) to be parked in or stand upon any parking area for a time in excess of the maximum continuous period stipulated in terms of section 1(2)(d) in respcet thereof or, having removed the vehicle from such parking area again to park or to stand upon such area until an interval of at least thirty minutes has elapsed since such removal. (P.N. 494/79; 254/87) (2A) No person in control of any public bus which is authorised by a current Bus Rank Permit to use any bus rank shall pick up or set down any passenger at any place within the bus rank other than a loading bay allocated in respect of such vehicle in terms of such Bus Rank Permit or an area demarcated for the setting down of passengers in terms of section 1(2)(b) as the case may be, or allow any person to board or alight from such vehicle at any such place. (P.N. 254/87) (2B) No person in control of a public bus shall disobey for fail to comply with a direction, prohibition or restriction conveyed by any notice displayed in terms of these bylaws or any sign or marking which is substantially the same as a road traffic sign within the meaning of the Road Traffic Ordinance, 1966 (Ordinance 21 of 1966) and regulations made thereupon which is displayed in the manner prescribed in such regulations. (P.N. 254/87) (3) No authorised person shall damage, disfigure, mutilate, obliterate, remove or in any other way interfere with any notice, sign or marking displayed or erected in terms of these bylaws or referred to therein. (P.N. 133/75; 256/76; 254/87) (4) Upon receipt of a written application from the owner of a public bus in respect of which a permit has been issued in terms of section 6, the Chief Constable may, upon payment of the prescribed fee, issue a permit disc authorising the said owner and/or his employees to park a light motor vehicle upon any bus rank for the purpose of making such collections or dealing with emergencies which have occurred on the bus rank involving public buses in respect of which a permit is in force in terms of section 6. Such disc shall stipulate a maximum parking period which shall not be exceeded; provided that, in the case of any bona fide emergency or breakdown or, if so authorised by a police officer, the disc holder may park the vehicle for such period as is reasonably necessary in the circumstances; provided further, that in no circumstances shall the permit be deemed to authorise the permit holder to park in such a way as to cause an obstruction to traffic. Section 6 - Application for Bus Rank Permit 1. Application for a Bus Rank Permit to use any bus rank or ranks shall be made in writing in the form prescribed in the Third Schedule to these bylaws, by the owner of the public bus or public buses in respect of which the Bus Rank Permit is sought and shall be addressed to the Chief Constable. (P.N. 494/79) 2. Upon the grant of an application made in terms of sub-section (1) the applicant shall, before the permit is issued to him, pay to the City Treasurer a sum of R264,00 in respect of each public bus; provided that when the period for which a Bus Rank Permit is issued is less than twelve months the amount payable shall be calculated at the rate of R22,00 per month or part of a month. Subject to the provisions of sub-section (2) hereof and of Section 8, the Chief Constable may in granting any application impose conditions: (a) restricting any bus in respect of which a Bus Rank Permit is issued to a particular loading bay or parking area or subdivision thereof which may be demarcated as hereinbefore provided in the bus rank concerned; (b) limiting the hours during which any bus rank or sub-division thereof may be used by the vehicle when not actually engaged in transporting passengers in terms of any Public Road Carrier Permit; (c) specifying the number of vehicles which may use any portion of any one bus rank or any subdivision of such bus rank; (d) any other condition which the Chief Constable may deem reasonable to ensure a fair allocation of the available accommodation or any bus rank between the variou applications or for avoiding obstruction and congestion of vehicles and passengers or to ensure the proper regulaton of traffic at or near the bus rank concerned. (P.N. 494/79) 2. In deciding to impose any condition, the Chief Constable shall have regard: (a) to the number of public buses which can conveniently be accommodated in the rank set aside in terms of the First Schedule to these bylaws for the use of vehicles to which the application relates, authorised by a Public Road Carrier Permit to operate on the routes having the destination or outer terminal described in the Public Road Carrier Permit and the Bus Rank Permit issued in respect of such public bus; (b) to any specified timetable referrred to in the Public Road Carrier Permit issued in respect of such vehicle and in accordanced with which such vehicle must be operated; (c) to the length of time during which the applicant for a Bus Rank Permit has been engaged in the business of transporting passengers for reward by public bus; (d) to the conditions of the relevant Public Road Carrier Permit issued in respect of such vehicle; (e) any other factor which may be relevant to the object of ensuring the fullest and most effective use being made of the bus rank concerned, with due regard to the convenience of passengers and the regulation of vehicular and pedestrian traffic at or near such rank. (P.N. 494/79) Section 8 - Power to refuse Application for or Cancel Permit 1. No Bus Rank Permit shall be granted or renewed unless the applicant is the holder of a valid Public Road Carrier Permit issued in terms of the Road Transportation Act, 1977, in respect of the vehicle concerned authorising the conveyance of passengers over the route specified in such permit; and any Bus Rank Permit or renewal thereof shall be suspended or cancelled ipso facto if the Public Road Carrier Permit in respect of the vehicle to which the Bus Rank Permit relates is suspended, withdrawn, cancelled or not renewed. (P.N. 494/79) 1A. The renewal of a Bus Rank Permit may at the discretion of the Chief Constable be refused or a current Permit may be cancelled by him if the holder of the Permit or any person in control of a public bus to which the Permit relates is convicted of an offence under these bylaws on more than three occasions during a period of three months and after receipt of a warning notice from the Chief Constable is again convicted of such an offence within the period of the succeeding three months. (P.N. 254/87) 2. The cancellation or suspension of a Bus Rank Permit in terms of this section shall not entitle the holder to any refund in respect of the fee paid by him. (P.N. 494/79) Section 9 - Bus Rank Permit to be in Prescribed Form 1. Whenever an application for a Bus Rank Permit is granted by him, the Chief Constable shall forthwith issue to the applicant a Bus Rank Permit substantially in the form prescribed by the Fourth Schedule to these bylaws, in respect of each public bus for which application for the right to use a bus rank was made. A Bus Rank Permit shall be valid only for the period stated thereon. 2. A Bus Rank Permit issued in terms of these bylaws shall specify the bus rank or ranks to which it relates and shall entitle the holder to use any loading bay and any available accommodation in any parking area set aside or demarcated in the bus rank to whcih his Bus Rank Permit relates, or which may be specified in the Bus Rank Permit allocated to him, subject to the conditions endorsed thereon and to the provisions of these bylaws. 3. The Council shall in no way be liable for the loss of or damage to any vehicle or any accessory or contents of such vehicles which has been parked in any bus rank. (P.N. 494/79) 4. The Chief Constable may replace a bus rank permit which has been lost or has become damaged on payment of a fee of R20,00 and submission of an affidavit setting out the circumstances occasioning such loss or damage. (P.N. 454/87) Section 10 - Bus Rank Permit to be Carried on Vehicle to which it relates, and Owner's name and address to be displayed 1. A Bus Rank Permit so issued shall at all times be carried in or upon the public bus to which it relates or in or upon any public bus which is lawfully substituted therefore and the driver thereof shall exhibit it to any member of the Durban City Police, South African Police, or any authorised official upon demand. Failure to exhibit such Bus Rank Permit on demand shall make the driver of such a public bus guilty of an offence. 2. The owner of any passenger carrying public bus shall cause his name and address to be legibly, permanently and conspiciously affixed on the side or sides of the vehicle. Such name and address shall be painted in block letters at least one inch in height and the colour of the letters shall be in contrast with the colour of the vehicle. (P.N. 494/79) Section 11 - Expiry and Renewal of Bus Rank Permit 1. A Bus Rank Permit issued in terms of these bylaws shall expire on the 30th day of June in each year. 2. Applications for the renewal of any Bus Rank Permit for the folloing year shall be made to the Chief Constable not later than the first day of June in each year, in the same manner as provided in Section 6 of these bylaws and upon the grant of such a application the provision of subsection (2) of that section shall mutatis mutandis apply; provided, however, that the Council may issue or make available an official form for the renewal of Bus Rank Permit incorporating such of the particulars detailed in the Third and Fourth Schedules of these bylaws as may be necessary or expedient in order to adapt such forms to its mechanical accounting systems. (M.N. 81/87) 3. Application for renewal made after 1st June, aforesaid, shall be treated as applications for new permits. (P.N. 494/79) Section 12 - Power of Chief Constable to Authorise substitution of Vehicle. If at any time a public bus to which a Bus Rank Permit relates is under repair, or if for any other reason the owner thereof so desires, the Chief Constable may, by endorsement upon the Bus Rank Permit authorise the substitution of another vehicle therefor either temporarily or for the duration of the Bus Rank Permit. Provided, however, that in the cases of urgency the Chief Constable may grant such authority verbally in which case the owner shall produce the relevant Bus Rank Permit for endorsement within 48 hours of such verbal authority having been granted. Provided further that when a substituted vehicle is to used for less than 24 hours such endorsement shall not be necessary. (P.N. 494/79) 12A Nothwithstanding the provisions of these Bylaws the Chief Constable may authorise the holder of a bus rank permit to interchange with public bus to which that permit relates to any other public bus owned by him where the public road carrier permits issued to him in terms of the Road Transportation Act, 1977 allow such public buses to be interchanged; provided that the total number of public buses owned by the holder and using any bus rank on any particular day shall not exceed the total number of bus rank permits issued to such holder in respect of that bus rank. (P.N. 212/82) 12B. Transferability of Bus Rank Permit to another Rank Subject to the provisions, mutatis mutandis, of sections 7 and 8, a current bus rank permit may, on application by the holder thereof to the Chief Constable and with his approval, be transferred without the payment of any additional fee to another bus rank, whether or not that rank is specified in the same part of the first Schedule as the rank to which the permit relates and the fact of such transfer shall be endorsed on the bus rank permit, whereupon the permit shall be deemed for all purposes of these bylaws to have been issued in respect of the bus rank to which it has been transferred. (M.N. 238/89) Section 13 - Preservation of Council's Rights 1. No rights possessed by the holder of any Bus Rank Permit under these bylaws or under such Bus Rank Permit shall operate to debar the Council from permanently or temporarily closing or removing any bus rank established hereunder, or from amending these bylaws or the Schedules appended hereto. 2. In the event of the Council considering it necessary for any reason to establish any bus rank either in substitution for any existing bus rank or additional thereto, the Chief Constable may issue a temporary Bus Rank Permit authorising the holder to operate to and from any such rank, prior to such rank being listed in the First Schedule. Application for such temporary Bus Rank Permit shall be made in terms of subsection (1) of section 6 and the amount payable shall be calculated in terms of subsection (2) of section 6 of these bylaws and the City Engineer shall for the purpose of such calculation determine in which Part of the First Schedule such rank will be listed. (M.N. 81/87) 3. Notwithstanding anything contained in these bylaws, the City Engineer may reserve any loading bay or bays, or any other area forming part of a bus rank established in terms of these bylaws, for the exclusive use of public vehicles belonging to the Council by the erection of signs in terms of bylaw 25 of the Durban Corporation Transport bylaws, as amended from time to time. (P.N. 373/63; 133/75; 494/79) Section 14 - Drivers to observe Bylaws and Instructions of Police 1. The driver or other person in control of any public bus shall exercise the rights conferred by the permit authorising such vehicle to use any bus rank with due regard tothe rights and convenience of other vehicles authorised to use the bus rank and their passengers; and shall, in addition to observing the requirements of these bylaws obey all lawful instructions or signals given by any member of the City Police. 2. For the purpose of these bylaws members of the City Police are hereby authorised to give such instructions or signals which may be necessary to avoid obstruction and congestion of vehicles or passengers and for the proper regulation of traffic at or near the bus rank. Section 15 - Queues 1. At any bus rank established in terms of these bylaws the Council may erect or cause to be erected queue signs consisting of a notice board indicating the position and manner in which persons waiting to board a public bus shall stand and form a queue which sign may or may not be supplemented by queuing barriers in the form of rails or lines marked on the surface of the area to be demarcated for the purpose of queuing. 2. Persons intending to board any vehicle at any bus rank or other stopping place at which queue signs have been erected shall form a queue at and from the point from which it is indicated that such vehicles will leave. 3. Persons forming any such queue shall take and give precedence according to their arrival. 4. No person shall board any vehicle at any bus rank or stopping place at which queue signs have been erected except from a queue (unless there are no other persons waiting to board the vehicle) and no person shall take any place in a queue in front of any person already in that queue. 5. Where no queue sign has been erected persons waiting at or near any bus rank or any public bus stopping place for the purpose of boarding a public bus shall form themselves in a queue not exceeding two abreast, or in single file when required thereto by any member of the City Police or South African Police. 6. Every person standing in any queue or boarding or attempting to board any public bus at any bus rank where a queue has assembled or a queue sign has been erected shall comply with all instructions given by any member of the City Police or South African Police as may be necessary for the proper control of the queue or for the prevention of obstruction to vehicular or pedestrian traffic. 7. No person shall board any motor bus at any bus rank until all persons wishing to alight therefrom shall have had reasonable opportunity to do so. 8. It shall be an offence for any person to enter or attempt to enter any public bus which contains the total number of passengers which it is authorised to carry after being warned by the conductor or driver not to do so. 9. Any person who fails to comply with any provision of this bylaw or who refused to obey the lawful instructions of any member of the City Police or South African Police or who behaves in a riotous or indecent manner or who is intoxicated, shall be guilty of an offence and may be removed from a queue or from the vicinity of the bus rank by any member of the City Police or South African Police. Section 16 - Public Bus Routes and Termini 1. No driver or person in charge of any public bus shall - (a) pick up or set down passengers or allow any passenger or intending passenger to board or leave such public bus except at a bus rank established in terms of these bylaws or at a bus stop or stopping place or stand designated in accordance with the provisions of Section 82 of Ordinance No. 10 of 1953 (as amended); (b) stop his vehicle at a bus stopping place or stand for a longer time than is reasonably necessary for setting down or picking up passengers. 2. No person shall tout, importune or solicit for passengers for any public bus by loitering or calling out or in any other manner whatsoever. 3. No person shall baord or attempt to board, leave or attempt to leave any public bus at any point along the route on which it is travelling other than a designated bus stop, stopping place or stand. (P.N. 359/63; 494/79) Section 17 - Penalties Any person who contravenes any of the provisions of these bylaws shall be guilty of an offence and shall be liable on conviction to a fine not exceeding R200 in the case of a first conviction, or in the case of a second or subsequent conviction, for the same offence, a fine not exceeding R400, or in default of payment of any fine imposed in either case, imprisonment for any period not exceeding three months. (P.N. 514/66) Section 18 - Commencement and Repeal of Bylaws 1. These bylaws shall commence to operate on the 1st day of the month following the date of their promulgation. 2. As and from the date of commencement of these bylaws the following bylaws shall be and are hereby reprealed: (a) Section 36, 36 (bis) and 36 (ter) of the Council's Motor Vehicle and Vehicle Bylaws published under Provincial Notice No. 325 of 1928, as subsequently amended. (b) The whole of the additional Traffic Steam and Motor Vehicle, Motor Car and Licensing Bylaws published under Provincial Notice No. 39 of 1925. (c) Section 150 bis of the General Bylaws published under Provincial Notice No. 26 of 1914, as subsequently amended. (d) The whole of the Locomotives (Street) Bylaws conferred by Proclamation No. 89 of 1898 in the Natal Government Gazette of 22nd November 1898. TARIFFS RELATING TO BUS RANKS AND ROUTES 1. Lorne Street: (a) Loading bays and loading platforms in the area bounded by Carlisle Street, Centenary Road, Lorn Street and Material Management Department. (b) Loading bay on the east side of Centenary Road between Carlisle Street and Lorne Street. (M.N. 201/90) 2. Merewent: Loading bays in the area open to the public bounded by two lines, both parallel to the north-eastern boundary of the Raj Mahal Hotel at distances of 33m and 55m respectively from the north-eastern boundary of the Raj Mahal Hotel, and extending between the road reserves of Ajmer Road and Raj Mahal Road. (M.N. 201/90) 3. Mansfield Road: Loading bays and platforms in the area bounded by Mansfied Road, the west side of the Warwick Avenue cul-de-sac, Old Dutch Road and Centenary Road.
