(1) Whenever in terms of this Scheme, the special consent of the Council is required for the development or use of land, the applicant for such special consent shall give notice of such application in a form approved by the City Engineer and in the manner hereinafter set forth.

Such notice shall be:

(a) published on the Friday after the date on which the application is made or on the Friday being the day on which the application is made, in an English and an Afrikaans newspaper printed, published and circulated in Durban;20/07/1981

(b) published in both official languages on a notice board posted conspicuously on the site to which the application relates, continuously for a period of not less than 21 days from the date on which the notice is published in the newspaper and placed so as to be clearly visible from every street from which access to the site is to be gained and maintained in a good and legible condition during the period specified, provided that the City Engineer may require the applicant to publish such notice on one or more additional notice boards on or in the vicinity of the site if he is of the opinion that a single notice will not effectively bring the proposal to the notice of members of the public. Such notice shall occupy a space of not less than 0,35 metres in length and not less than 0,50 metres in width and shall be in bold, legible and durable Roman characters and shall be of a size proportionate to the available space;

(c) served upon the owner or occupier of every adjoining site other than a vacant site by posting a copy of such notice to each such owner or occupier by registered post within a period of 21 days terminating upon the date of publication referred to in sub-paragraph (b) hereof.

(2) Any person may object to the granting of the authority by giving written notice to the City Engineer setting out therein 12/12/1980

the grounds of objection, simultaneously serving a copy thereof on the applicant and certifying to the City Engineer that he has done so. Nothing herein shall, Such objection shall be lodged before a date specified in the published notice, which shall not be earlier than 21 days from the date of publication of the notice or where the city engineer requires further notices to be displayed in terms of the proviso to sub clause (1) (b) hereof, within 22 days from the date of erection of such further notices. Noting herein shall, however, be construed as giving the applicant or any objector the right to appear before any committee or sub-committee of the Council in connection with the application or any objection thereto.20/07/1981

(3) The Council shall take into consideration any objection received within the periods referred to in sub-clause (2) above and shall notify the applicants and the persons, if any, from whom objections were received, of its decision.12/12/1980

(4) Where any objections to any application for the special consent of the Council are timeously lodged, the decision of the Council shall not take effect until the expiration of 21 days from the date on which the applicant and the objectors are notified of such decision or, if an appeal has been lodged against such decision, until such appeal has been disposed of.

(5) Where an alteration to or an extension of a building requires the special consent of the Council, the Council may waive the advertisement requirements of sub-clause (1) hereof if such alteration or extension does not affect the external appearance of the building and no change of use is involved.

(6) Whenever, in the relevant notice published in terms of Local Authorities Ordinance No. 25 of l974, and in a notice exhibited in accordance with sub-clause (1)(b) hereof, the Council has published its intention to alienate immovable property for a purpose for which the special consent of the Council would be required, the special consent of the Council to the use of such property for such purpose shall be deemed to have been granted, provided that, if objections are lodged in terms of such notice, no further steps for the alienation of the property shall be taken by the Council until such objections have been disposed of in accordance with the provisions of this Scheme and the Town Planning Ordinance.16/09/1991
