(1) The layout of any petrol service station, including the siting of pumps, buildings and of access and egress, shall be to the satisfaction of the City Engineer; provided that no spray painting or panel beating shall be carried out at a petrol service station except with the approval of the Council; provided further that in respect of the site on Old Mill Way at Holmpark Place, there shall be no access from Holmpark Place and the site shall be screened to the City Engineer's satisfaction along this frontage.
(2) (a) A petrol service station shall be permitted only on a site specifically zoned for the purpose or by special consent in areas zoned Special Shopping, General Shopping, General Business (Central Area), Harbour, Indeterminate or for industrial purposes.
(b) A petrol service station having direct vehicular access to a freeway shall not be permitted.
(c) The following pre-requisites and conditions shall be observed whenever it is proposed to erect a new petrol service station or to alter or extend an existing petrol service station:-
(i) No vehicular entrance to or exit from a petrol service station shall be within 150 metres of a freeway interchange, 60 metres of an intersection with a road which in the opinion of the City Engineer is a major road or 20 metres of an intersection with any other road.
(ii) The frontage of a petrol service station site to a road shall not be less than 36 metres in length and the number, width and siting of all vehicular access points across such frontage and the minimum distances between such points shall conform to and be within the limits set by figures, distances and dimensions reflected on the diagrammatic sketch in Appendix 3.
(iii) Dwarf walls or other permanent structures satisfactory to the City Engineer shall be erected on the street frontage of the site so as to confine the movement of vehicles into or out of the service station to the authorised access points.
(iv) No petrol service station shall be established upon any site unless, in the opinion of the City Engineer, it has an adequate depth so as to enable all activities to be carried on clear of the street. Filler points for underground tanks shall be so located as to make it possible for tanker vehicles to stand wholly within the curtilage of the site when recharging the tanks and for such vehicles to enter and leave the site in a forward direction.
(v) Pump islands shall not be less than 5 metres from any boundary of the site and all traffic routes within the forecourt area shall have a minimum width of 5 metres.
(vi) A petrol service station shall have a minimum distance of clear visibility of 120 metres in both directions along any road on to which traffic is discharged from the forecourt measured from a height of 1,37 metres above the road at the exit point to an object 1,37 metres high; provided that where a street is divided into two or more roadways by means of a physical barrier, then the above visibility shall only relate to the direction of approach along the roadway adjoining the forecourt of the petrol service station.
(vii) A petrol service station shall not be sited on a street having a gradient at any point within 120 metres of any access point to the service station steeper than 1 in 7, and access ramps from the street shall not be steeper than 1 in 7 with vertical curves of at least 30 metres radius at the top and bottom of ramps.
(viii) A petrol service station shall be so sited and designed that the traffic entering and leaving the site will not adversely affect movements of pedestrians or vehicles on any heavily trafficked public street or place.
(ix) In view of the interference with amenity which petrol service stations in predominantly residential areas are likely to give rise, by virtue of such matters as fumes, odours, noise, congestion of traffic, unusually long hours of operation and so on, an application for a petrol service station in such an area shall only be granted if the applicant is able to establish that such a facility is necessary in order to meet the needs of the residents of the area.
(x) the argument based on the solo-site system that all brands of petrol should be available within any particular area shall not be taken into account when considering applications for the establishment of petrol service stations
(d) The Council may relax any of the requirements of sub-clause (c) other than the requirements prescribed in paragraphs (ii), (iii) and (viii) if it is satisfied that no interference with the amenities of the neighbourhood existing or as contemplated by the Scheme will result or that the development in accordance with such requirements would be less harmonious with adjoining properties than would be the case if the requirements were relaxed; provided that no relaxation shall be granted so as to permit a vehicular access point having a width along the street frontage of the site of less than 3 metres or more than 9 metres.
(3) Where special consent authorising the sale of motor vehicles at a petrol service station is granted, it shall be subject to the condition that all such vehicles are displayed for sale or stored pending sale, only in showrooms and/or on those portions of the site, the situation and layout of which have been approved by the City Engineer.04/02/1974
(4) (a) No goods other than motor fuels, lubricants, motor spares and accessories and where permitted motor vehicles, shall be sold at a petrol service station without the authority of the Council granted in terms of paragraph (b) hereof.16/06/1975
(b) (i) On application being made to it, the Council may permit articles of sales promotional goods manufactured, marketed or supplied by an oil company and also beverages and cigarettes to be sold at petrol service stations and only such items as the Council specifies may be so sold.
(ii) The applicant shall specify in his application the additional items which he desires to sell and if vending machines are to be installed shall state the number and proposed situation on the premises of such machines and the items which it is proposed to dispense therefrom.
(iii) In granting permission in terms of paragraph (i) the Council may impose such conditions as it may deem necessary.
(iv) The applicant shall ensure that the layout of the premises including the siting of any vending machines is such that conflict between pedestrians and vehicles using the premises will be obviated to the satisfaction of the City Engineer.
(v) Where a petrol service station has been established on part of a site other than one zoned for petrol service station purposes, the use of the remainder of the site for any permitted uses shall be subject to such conditions as the Council may consider necessary in order to obviate conflict between vehicles using the petrol service station and pedestrians or other vehicles using the remainder of the site.
16/09/1991 (c) The applicant shall ensure that the General Dealers Licence and any Vending Machine Keepers Licence that may be necessary in terms of the Licences and Business Hours Ordinance No. 11 of 1973 is endorsed so as to restrict the authority conferred thereby to the sale of such items or classes of goods as may be approved by the Council in terms of paragraph (b).
