(1) All streets which are shown on the map in one or other of the colours used to denote a use zone or the reservation of land and hatched in black are streets to be closed. Such streets shall continue to be used as streets until permanently closed by the Council in accordance with sub-clause (2) hereof 16/09/1991
(2) The streets or portions thereof to be closed in terms of sub-clause (1) hereof shall be closed by the Council in terms of section 211 of the Local Authorities Ordinance No. 25 of 1974, as amended from time to time or in terms of any other law which confers power on the Council to close public or private streets; provided that no such street which provides the sole means of access to an existing subdivision abutting thereon shall be closed until alternative access to such subdivision has been provided to the satisfaction of the Council.
(3) The closure of a street in terms of this clause shall not interfere with the rights of the Council in respect of any sewer, drain, water main or electric cable or wire or other existing Municipal service in, on, over or under such street and the Council shall have the same powers in relation thereto (including the power of inspecting, maintaining, replacing and repairing the services and connections thereto and of the entry upon the land for that purpose), as if the street had not been closed; provided that the Council may, at the request of the owner of the land and subject to such conditions as it may deem fit to impose, divert or transfer any such service and execute any works and do all other things necessary for such diversion or transfer. 18/05/1987
(4) No new access to a subdivision shall be permitted from any portion of a street which is to be closed in terms of this clause unless the Council otherwise directs and any existing access from such portion shall be removed upon the redevelopment of the subdivision, or at the discretion of the Council, upon a change of use of the subdivision.
